Terms and Conditions

These terms apply to your use of hupband.com and to communications with Heads Up Penny LLC (“Heads Up Penny,” “we,” “us”). Booked performances are governed by the separate written agreement for each event.

SMS messaging terms

• Program: Heads Up Penny sends text messages about your inquiry and event, such as availability, quotes, booking details, scheduling and event-day logistics, to people who opt in.
• Opt-in: You opt in by checking the SMS consent box on our inquiry form or by texting us first. Consent is not a condition of booking.
• Message frequency varies.
• Message and data rates may apply.
• Opt out: Reply STOP to cancel at any time. You will receive one confirmation message and no further texts unless you opt in again (reply START).
• Help: Reply HELP for help, or email owner@headsuppennyband.com.
• Carriers are not liable for delayed or undelivered messages.
• Mobile numbers and SMS opt-in consent are not shared or sold to third parties or affiliates for marketing purposes. See our Privacy Policy.

Website use

Site content, photos, video and recordings belong to Heads Up Penny or their owners and may not be reused without permission. Information on the site, including song lists and show dates, may change without notice. Submitting an inquiry does not reserve a date; a date is reserved only by a signed agreement and any required deposit.

Limitation of liability

The site is provided “as is.” To the extent allowed by law, Heads Up Penny is not liable for indirect or consequential damages from use of the site or messaging program.

Governing law

These terms are governed by the laws of North Carolina.

Changes

We may update these terms and will post the new version here.
